These Terms and Conditions apply to products and services offered, manufactured, distributed or sold by BigBoost, LLC, referred to in these terms as “BigBoost Turbo,” “BigBoost,” “we,” “us” or “our.”

By placing an order, accepting delivery, authorizing work, installing a product or using a product, the purchaser and end user acknowledge that they have reviewed, understood and agreed to these Terms and Conditions.

• Prices, product specifications, availability and website content are subject to change without notice.
• BigBoost Turbo is not responsible for typographical errors, incorrect descriptions, misprints or omissions appearing on the website.
• BigBoost Turbo reserves the right to add, remove, modify or substitute products, pricing, specifications and website content at its sole discretion.
• If an error affects an order, BigBoost Turbo may contact the purchaser to correct, modify or cancel the affected portion.

• Unless other arrangements are approved by management, all purchases must be paid in full before production or shipment.
• BigBoost Turbo may accept cash, certified checks, bank checks, money orders and approved credit cards.
• Company or business checks are accepted only after prior approval by BigBoost management. Personal checks are not accepted.
• Initial credit-card orders may be required to ship to the verified billing address.
• International orders may require advance payment by direct bank transfer.
• Verified Canadian PayPal transactions may be accepted at BigBoost management’s discretion and are subject to a 3% service charge.

Any check or payment returned for insufficient funds or otherwise rejected is subject to a $40 returned-payment fee. The affected account may be placed on hold and referred for collection.

The customer is responsible for legally recoverable collection expenses, court costs and attorney fees associated with an unpaid balance.

• An approved cancellation requested within the first ten calendar days after order placement is subject to a 6% cancellation and processing fee.
• An approved cancellation requested after ten calendar days is subject to a 10% cancellation and processing fee.
• Cancellation requests are not guaranteed. An order that has shipped, been completed, entered final assembly or otherwise become non-cancellable cannot be cancelled.
• Shipping charges, payment-processing charges, special vendor costs and non-recoverable expenses may also be deducted when applicable.

• Custom, special-order and made-to-order products may require a deposit of 50% to 100%, as determined by BigBoost management.
• A custom or made-to-order item may be cancelled only during the first five calendar days after order placement, subject to the applicable 6% cancellation fee.
• After five calendar days, custom, special-order and made-to-order items are non-cancellable, non-returnable and non-refundable.
• This policy includes custom fabrication, custom manifolds, coatings, modified components, built assemblies and products manufactured or purchased specifically for the customer.
• Estimated lead times are estimates only. Many special orders may require approximately six to ten weeks unless a different estimate is provided.

• All returns require a Return Merchandise Authorization issued by a BigBoost Turbo representative.
• The return must be authorized, shipped and received by BigBoost Turbo within 30 calendar days of the original invoice date.
• Merchandise must be unused, uninstalled, undamaged, complete and in new condition with all original packaging, hardware, instructions and components.
• Eligible returns are subject to inspection and a 25% restocking fee.
• Return freight must be prepaid. Freight-collect shipments will not be accepted.
• Customers are responsible for appropriate packaging and for retaining tracking and delivery records.
• Approved merchandise returns are issued as credit toward future purchases. Cash refunds are not authorized for returned merchandise.

The following products are not returnable:

• Custom, special-order and made-to-order products after the five-day cancellation period.
• Custom fabrication and custom work.
• Installed, used, modified, damaged, incomplete or opened products.
• Electronic merchandise.
• Discontinued products.
• Blowout, specially priced, quantity-discounted, clearance or promotional items identified as final sale.

Contact BigBoost Turbo before returning any product. The RMA number must be clearly associated with the return shipment. Packages received without prior authorization may be refused and returned at the sender’s expense.

Issuing an RMA does not guarantee a refund or credit. Final eligibility is determined after inspection.

Refusing delivery does not create an automatic right to a refund, exchange or credit.

A refused shipment may result in suspension of the customer’s account until all applicable charges are paid. Applicable charges may include:

• A $35 refused-shipment fee.
• Original shipping charges.
• Return shipping charges.
• Carrier fees and customs charges.
• Applicable restocking fees.

• Unless otherwise stated, shipments are sent FOB Origin from BigBoost Turbo’s shipping location in Miami, Florida.
• Estimated production, fulfillment and shipping dates are not guaranteed and may change.
• Carrier transit time begins after the completed order is accepted by the carrier.
• Carrier service days generally exclude weekends and carrier-observed holidays.
• Orders requiring address, payment, identity or fraud verification may experience additional processing time.

Backordered products will be fulfilled as inventory becomes available. When an order includes both available and backordered products, BigBoost Turbo may hold the order until it can be shipped complete.

A customer may request a partial shipment. Additional shipping charges may apply.

• International orders may require advance payment and additional verification.
• Shipping charges do not include customs duties, import taxes, brokerage fees or government charges.
• All importation charges are the customer’s responsibility and are not paid or reimbursed by BigBoost Turbo.
• BigBoost Turbo will declare shipment contents and commercial value accurately and will not alter customs documentation to reduce duties or taxes.
• A shipment refused because of unpaid import charges may be subject to return freight, customs clearance charges and other deductions.

• Inspect all shipments promptly upon delivery.
• Shipping damage, shortages or discrepancies should be reported immediately.
• Retain all cartons, packaging, labels and damaged products for carrier inspection.
• Damage claims must be made with the shipping carrier when required by the carrier’s terms.
• BigBoost Turbo recommends purchasing sufficient shipment insurance because carriers may limit liability.
• Failure to retain packaging or provide requested evidence may result in denial of a shipping claim.

Approved drop shipments are subject to a $10 service fee in addition to normal shipping charges. Any additional vendor drop-shipment fee will also be charged to the customer.

• Mechanical, electrical, fueling, exhaust and turbocharger products should be installed by qualified professionals familiar with the specific vehicle and application.
• The purchaser and installer are responsible for confirming correct product selection, sizing, fitment and compatibility before installation.
• Improper installation, incorrect fitment, inadequate supporting modifications or incorrect calibration can cause unsafe operation, product failure or vehicle damage.
• Modified vehicles may require frequent inspection, adjustment, maintenance and replacement of components.
• An upgraded turbocharger system must not be operated under boost until an appropriate calibration and all required mechanical checks have been completed.

Warranty coverage varies by product and manufacturer. Unless a written BigBoost product-specific warranty states otherwise, only the applicable manufacturer warranty is provided.

• Warranty does not cover abuse, racing damage, accidents, impact, fire, crash damage, improper installation, improper fitment, incorrect calibration, inadequate supporting components, modification or unauthorized repair.
• BigBoost Turbo or the applicable manufacturer may inspect the product before determining warranty eligibility.
• For an eligible claim, BigBoost Turbo may elect to repair, replace, provide company credit or issue another remedy at its sole discretion, subject to the applicable warranty.

All BigBoost Turbo products are designed and intended exclusively for racing competition use.

Products are not represented as lawful for use on public highways. The purchaser assumes responsibility for confirming and complying with all federal, state and local laws.

Installation of performance products may void vehicle or component warranties, increase noise and vibration, reduce drivability, increase maintenance requirements and create a risk of vehicle or component damage.

Purchase, installation and use are at the vehicle owner’s risk.

• A core charge may be added when a rebuildable core is required and is not provided at the time of purchase.
• Eligible cores must be received within 30 days of the applicable invoice.
• Returned cores must be complete and in rebuildable condition.
• All cores will be inspected and tested. The amount of core credit is determined by condition and at BigBoost Turbo’s discretion.
• Core credit is applied toward future purchases. Cash refunds are not authorized for core returns.

• No warranty is provided on high-performance work except where specifically stated in writing.
• Custom work and fabrication are non-refundable.
• High-performance modifications can cause or contribute to the failure of original and aftermarket vehicle systems.
• Modified vehicles may require increased maintenance, adjustment and replacement of parts.
• BigBoost Turbo is not responsible for car rentals, airfare, taxi charges, towing, lost use or other expenses resulting from completion delays.

• Completed work and outstanding balances must be paid as required before a vehicle or product is released.
• A storage fee of $15 per day may apply beginning on the third day after notice that work is complete.
• If a vehicle is not collected and the balance remains unpaid for more than 30 days, BigBoost Turbo may pursue a mechanic’s lien and other remedies allowed by Florida law.

• BigBoost Turbo is not responsible for valuables left inside a vehicle.
• Vehicles may be stored outdoors.
• Customers may provide a vehicle cover, which BigBoost Turbo will make reasonable efforts to use.
• To the fullest extent permitted by law, BigBoost Turbo is not responsible for damage caused by fire, theft, vandalism, weather, hail, animals or other events outside its reasonable control.

When applicable, BigBoost Turbo may operate or test-drive a vehicle to verify function, diagnose concerns or perform an engine break-in procedure.

• The customer must provide valid registration and proof of liability insurance before on-road testing.
• BigBoost Turbo is not responsible for unrelated mechanical or electrical failures that occur during authorized testing.
• BigBoost Turbo is not responsible for problems that cannot be identified because the customer declines or prevents an appropriate test drive.

BigBoost Turbo may consider a vehicle abandoned when it has remained on the premises for more than 30 days, has an unpaid balance and the owner has stopped responding to telephone, mail and electronic communications.

BigBoost Turbo may provide written notice and a 15-day opportunity to resolve the outstanding balance. Storage charges of $20 per day may apply after the date of formal notice.

BigBoost Turbo reserves the right to pursue lawful lien, possession, sale or other remedies necessary to recover unpaid amounts.

The purchaser is responsible for determining whether a product is suitable for the purchaser’s vehicle, intended racing use, horsepower level, fuel, calibration and supporting modifications.

High-performance products and services can reduce reliability, increase maintenance requirements and cause vehicle or component damage. The purchaser accepts these risks.

To the fullest extent permitted by law, BigBoost Turbo will not be liable for indirect, incidental, special, consequential or punitive damages, including loss of use, lost profits, lost racing opportunities, vehicle downtime, rental expenses, towing or transportation expenses.

Nothing in these terms excludes liability that cannot legally be excluded under applicable law.

These Terms and Conditions and all transactions with BigBoost, LLC are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

To the extent legally enforceable, disputes shall be brought in the appropriate state or federal court located in Miami-Dade County, Florida, and the purchaser consents to jurisdiction and venue in those courts.

BigBoost Turbo may revise these Terms and Conditions without prior notice. The version in effect on the date an order is placed generally applies to that transaction unless applicable law requires otherwise.
